Independent legal advice FAQs

It is a document signed by a lawyer confirming they have explained the loan and guarantee documents to you, that you understand them and that you are signing voluntarily. Lenders usually need it before the loan can settle.

The lender may be able to recover the debt from you, which can include selling property you have offered as security. That is why lenders require independent advice. We explain exactly what your documents allow the lender to do.

Sometimes. Some lenders allow a guarantee capped at a set amount, and a guarantee can often be released once the loan is paid down or refinanced. It depends on your lender and your documents, and we will go through your options with you.

$599 including GST for one guarantor, or $799 including GST for two guarantors on the same loan. The fee is fixed and agreed before your appointment, and includes witnessing of your guarantee and statutory declaration.

Yes. We offer video appointments to guarantors anywhere in Australia, and most appointments take about 30 minutes. If you or your lender would prefer to meet face to face, we can see you in person in Newcastle.

Usually within 24 hours of your appointment, once we have your documents. Evening and weekend appointments are available if you are working to a tight settlement date.

That is your decision to make. Our role is to make sure you understand the documents, and you are never under pressure to proceed.

Know what you're guaranteeing before you sign.
